      5. Your product Preferences and Submissions, which generally includes information you voluntarily provide through vehicle make/model requests, questionnaires and surveys, product and/or service requests, free form text boxes, forums, document upload, or data retrieval or import. 

    In each of the above instances, you will know what personal information we collect through our site and services because you voluntarily and directly provide it to us.

     

    Other Information We Automatically Collect through Cookies and Other Technologies

     

    We or our third-party service providers may collect and store certain technical information when you use our site and services.     We may not respond to “Do Not Track” browser signals.  Accordingly, your navigation on our site and services may be tracked as part of our efforts to gather user information described above.  If you arrive at our site and services by way of a link from a third-party site that does respond to “Do Not Track” browser signals, such “Do Not Track” browser signal recognition may end as soon as you reach our site and services.

    We will not share any mobile information that you provide us with any third party or affiliates for marketing/promotional purposes.  Any information that we share on your behalf will be for informational and limited to only those partners you chose, and will be for informational, transactional and/or customer service purposes only.  The information that you provide will not be shared with any third parties for telemarketing purposes.

When you communicate with us by email, submit an online form through our site and services, request a quote or information, purchase a product or service, or otherwise submit a request through our site and services, the personal information you provide may be shared with third parties, including any dealership selling a vehicle you have reviewed and approved to proceed to purchase, to process or respond to your request and to provide you with the products or services you requested.  Upon reviewing vehicles that match your search criteria and the pricing Driver Seat has negotiated with dealerships on your behalf, you’ll provide approval to move forward with the purchase process with the dealership and Driver Seat with share your contact information with that dealership.  Privacy policies for dealerships are separate from this Driver Seat Privacy Policy.
    3. Where necessary to operate our site and services, your personal information and the contents of all of your online communications on or through our site and services may be accessed and monitored:
      1. To satisfy any applicable laws or regulations,
      2. To defend ourselves in litigation or a regulatory action,
      3. In order to protect our rights or enforce our Terms of Service,
      4. When we have a good faith belief that we are required to disclose the information in response to legal process (for example, a subpoena, court order, or search warrant),

    Please be aware that certain records and information will be retained for specific purposes such as legal, payment, accounting, technical, dispute resolution, enforcement of our Terms of Service, or customer service.  We may reject requests that are unreasonably repetitive or impractical, require disproportionate technical effort, or risk the privacy of others.

     

    Email and Other Communications

     

    By using this website and/or by providing us with your personal information, you expressly consent to give to us the right to contact you to discuss and provide our services and, upon your approval to proceed with the purchase of a specific vehicle, you consent to Driver Seat sharing your contact information with the dealership to attempt to sell, finance and/or service a motor vehicle.  Such contact may be made to the number that you provide, whether land line number or mobile phone number, using automated telephone dialing systems, text and/or pre-recorded messages, and video conferencing.  By providing us with your information, you expressly consent to these methods of contact and the onward transfer of your consent to the parties who will be contacting you about your request.  You also expressly consent to the packaging of your information and transaction of your information – for compensation or otherwise – to a vehicle seller or related party.

     

    Your use of this website and/or the act of providing us with your personal information establishes a business or other applicable relationship with us for purposes of CAN-SPAM, the Telephone Consumer Protection Act and all other applicable law that addresses unsolicited commercial communications.

     

    Text Messaging

     

    As a part of our communication with you for the services you purchased, we may send you text messages to provide status, collaborate on questions we may have or you may have during the locate and negotiate process, or other quick communication we deem necessary to successfully deliver services.  If you prefer communication from Driver Seat avoid the use of text messages and instead focus on phone calls or emails, you may make such a request to the Driver Seat representative helping you with purchased services.

     

    Protecting Personal Information

     

    We use reasonable and appropriate administrative, physical, technical, and data security procedures and controls to safeguard your personal information against unauthorized access, disclosure, loss, misuse, and alteration. Under applicable law, we are required to apply reasonable and appropriate measures to safeguard the confidentiality, integrity and availability personal information residing on and processed by our site and services.

     

    We use third-party service providers to manage credit card and payment processing.  These service providers are not permitted to store, retain, or use billing information except for the sole purpose of credit card and payment processing on our behalf.  When you enter payment information to be processed by our third party service providers, the transmission of that information is encrypted.  Upon transmission of that information, the respective privacy statement and/or privacy policy of the third-party service provider will govern how your credit card and/or financial information is stored.
